Guidelines and Waiver

Please take a moment to read through our guidelines and sign digitally in the arrival confirmation indicating your agreement. We wish that you have the best stay possible, we hope that you stay safe, and above all, please enjoy your time here!

Guidelines

• Pay rent on arrival and on arrival time, as agreed upon (i.e. monthly).
• Be aware of community vs. personal food storage in community areas. Don’t take food unless you know it is community food. Do not take other people’s food without permission; that is theft and you will be fined for it from your security deposit in addition to having to reimburse the food.
• If you have any grievances or complaints about our facilities, staff, or other residents here, please bring it up with any one of the owners or managers that you are comfortable with such as Boris, Kailey, Nik, etc, and we will do our best to resolve whatever problem you may have; we ask of everyone to communicate openly and maturely with non-violence. You can also fill out the complaint form here if you wish to have something on record or have mediators involved.
• Abide by the security deposit policy rules. See them here: security-deposit-policy By signing this you agree that you have read those and will follow them.
• We request everyone to attend our safety class, if one is scheduled during your time here, where we will discuss basic safety protocols regarding first aid, tools, clothing, snakes, spiders, insects, sanitation, and any questions you may have. If there is no class scheduled, please read the notices linked in the welcome page and on the walls in our community areas for important information. 

• We provide lockers for people staying in tents at FH1, where we recommend that you keep your valuable items when not in use, we will not be responsible for any theft that may occur by leaving items unattended outside of lockers. If a locker has not been made available to you, please let us know so that we can accommodate you.
• We are not responsible for any injuries or sicknesses that may occur, but will do our best to inform you as to avoid these things, and assist you if something does occur.
• Animal products, alcohol, cigarettes and drugs are not permitted in the Fruit Haven community areas. Please read the page: diet-and-lifestyle By signing this you agree that you have read those and will follow them.
• We are not responsible for any damage caused to your property, including clothing, electronics, etc because of mold, mildew, rats, cockroaches, moths, floods or natural disasters etc. We try to keep pests to a minimum in our houses. We recommend you keep your clothing dry, and keep it neatly folded or hung, don’t leave it tossed and crumpled on the floor. Don’t let damp clothes stay damp.
• Please do not enter private homestead areas at Fruit Haven without the permission of the owner. We wish to respect people’s need for privacy.
• We are not responsible for faulty perceptions of what Fruit Haven Ecovillage is and isn’t, based on your own projections. You may come here thinking it is a fully raw-is-law 100% fruitarian community with no greens and then get mad when you see someone cooking a plantain. Or you may assume it is an ultra-ethical vegan animal activist/ALF community, or even better, a new-age hippie bum pothead community, etc. We represent ourselves extensively on our website, we assume that you read it thoroughly and objectively before coming here. We are not your specific brand name of Eden Fruitarianism or Intersectional Vegan Activism or Breatharian Transcendentalists. We are an awesome community of permaculture fruit growers eating plant-based and doing as little harm to ourselves, the animals, and the planet, as we practically and possibly can. We are a diverse group of individuals with different ideas and we set aside our minor differences for the good of the community.

In order to continue your stay here, we request that you sign digitally, our waiver, by signing you also indicate your agreement to the above guidelines.

Release and Waiver of Liability

This Waiver of Liability (the ‘Waiver’) executed on the date of the signature, in favour of Fruit Haven Ecovillage and its co-owners, community members, and employees.

I acknowledge that staying at Fruit Haven Ecovillage at any time may involve risks including but not limited to injuries due to rough terrain, venomous snakes, spiders and insect bites, parasites, as well as the actions of other people.

I hereby assume all of the risks of staying at Fruit Haven Ecovillage including (as examples and not by way of limitation): any risks arising from negligence or carelessness on the part of the entity being released, from defective or dangerous equipment or property owned, controlled, or maintained by the entity, or because of their possible liability without fault. I agree that my safety is primarily dependent upon my taking proper care of myself.

I hereby release and forever discharge and hold harmless Fruit Haven Ecovillage, its participant farms and owners, and its successors and assigns from any and all liability claims, as well as demands of whatever kind or nature, in either law or equity, that arise or may hereafter arise from my participation. I understand that this releases Fruit Haven Ecovillage from any liability or claim that I may have against it with respect to any bodily injury, personal injury, illness, death, theft, or property damage that may result from my activities with Fruit Haven Ecovillage.

I understand that, except as representatives of Fruit Haven Ecovillage agree to in writing, Fruit Haven Ecovillage does not carry or maintain medical, health, or disability insurance coverage for its residents, guests, tourists, etc. I am expected and encouraged to obtain my own medical or health coverage.

I understand, agree and reviewed the security deposit policy (linked above) of Fruit Haven Ecovillage.

I hereby grant and convey all right, title, and interest in any and all photographic images and video or audio recordings made by Fruit Haven Ecovillage during my participation, including but not limited to any royalties, proceeds, or other benefits derived from such photographs or recordings.

By signing this waiver I am agreeing that Fruit Haven Ecovillage and its employees, co-owners, residents, guests, etc are not to be held legally responsible in the case of accident or injury.

This waiver shall be construed broadly to provide a release and waiver to the maximum extent permissible under applicable law. I agree that in the event that any clause or provision of this waiver and release shall be held invalid by any court of competent jurisdiction, the invalidity of such a clause or provision shall not otherwise affect the remaining provisions of this waiver and release, which shall continue to be enforceable. I agree that any and all claims or litigation arising from my participation in this activity will be governed by the laws of the Republic of Ecuador.

I certify that I have read this document and I fully understand its content. I am aware that this document is a contractual release from liability and that I sign it in the arrival confirmation form of my own free will.
